Tenant just informed me that they have to leave the country in a month. I told them they have to pay rent until end of contract or find a suitable renter in their place.
I am wondering what I can do if they decide to leave and not pay remaining months' rent or find a suitable renter for me. Besides keeping their deposit is there anything that can be done?

  • Start looking for a new tenant, you can't collect from another country.

  • Honestly there is nothing you can practically do to get the money. This sort of thing is part of being a landlord. Find a tenant asap and chalk it up to investments carrying risk.

  • Why would you trust him to find a suitable tenant? I'd rather find one myself

  • You can file with RTB and he'll have a judgement against him, but you won't be able to collect overseas

    You'd have to wait for him to come back to Canada to collect

  • You have a duty to minimize your losses, so it's up to you to put in the effort to find a new tenant. Now that you know they are leaving you need to put up rental ads now and try to find a new tenant.

    Also, make sure you understand how deposits must be handled at the end of a tenancy, even if the tenant owes you money you can not unilaterally keep it in many situations. The have a year to provide a forwarding address in writing and then you can legally keep it. You also still need to do a move out inspection with them, if you can.

    As the landlord, why should they be expected to work?

  • YOU need to find the new tenant, and you should start your search immediately.

    In order to get a judgement against them (that realistically they won’t pay anyways) YOU need to prove you tried to mitigate your losses by doing your best to find a new renter.

    You’re in Vancouver it should be really easy to replace this tenant. In the event that you can’t and you’ve done your best then the RTB should order the tenant pay whatever amount your lost - but your going to need to prove you immediately took steps to try and prevent missed rent by finding a replacement.

    We are great tenants, currently month to month with a big corporate landlord. They have shown us thy are not flexible and don't value us as tenants. So we are ready to go just have to give them the 30 day notice.

  • Is that the giving you 1 months notice? Are they on a fixed term tenancy? If so when does it end?

    In cases where they just disappear not much you can do other than file to retain their damage deposit

    Also that's not how rental contracts work. They have to pay every month it takes YOU to find a new tenant, Not them find a new tenant. You also have to document actually trying to find a new one because they can come after you if you don't actually look.

    It sucks when people break leases but it is what it is, you'll find a replacement pretty quick.

  • If this wasn't the Vancouver sub, I'd say even just the way you worded it screams "ICE took my tenant, not my responsibility they can't pay while being detained"

    This is why no matter how much land I could ever own, could NEVER get me to be a landlord. Just for the peace of mind even, catch me giving the property away before I rent to strangers...

    You took on the risk stranger, deal with it. Wouldn't go blaming a bankrupt company for your poor decision to invest right? Same logic

  • Why would you want them to find a renter? They’re easy to find and you can find one that you trust better than somebody else could find one.

  • Yeah... It is not the tenants responsibility to find a new renter. They can.. They can help find someone, they could sublet if you allow it.. But they don't have any obligation to find a replacement for you. It is your responsibility to find a new tenant and mitigate losses. Sounds like you may be Sol though. Because the process would be to take them to rtb for losses, and if they aren't even in the country, you may have a very hard time with that... Next time maybe rent to someone that isn't from a different country.. (Assuming they are leaving because they arent Canadian... If the are and leaving then I don't know what to tell ya...)

    And if you had a tenant break their lease and not leave the country, if you went to rtb to get money back and blamed the tenant for not being able to rerent the unit, because they didn't find a new tenant, you would lose, because you need to prove you did all you can to mitigate losses. If you do all you can, including lowering rent, rtb would likely order that the tenant owes for any months you were unable to rent for, as well, if you have to rent it for less to get someone in, they would have to pay the difference in rent for the remainder of the lease. So you definitely want to put on the effort yourself. Besides... If you let a tenant find a tenant, you don't know who is moving in, you should want to vet the new tenant and make sure they are a good fit for you.

    You have an obligation to mitigate your losses. That means replacing the tenant, and accepting this situation. Tbh, practically anyone can break a lease right now without more than like, a month's rent cost as your obligation and the number of applicants right now also means that it's very easy to replace a renter, and you shouldn't take more than a month to do so. Thus the person breaking their lease rarely has to pay more than that.

    The correct response here is to get a new tenant, and learn the lesson.

    this isn't quite right. the end of the contract has zero relevance since the tenancy ends when the tenant vacates the unit. At that point, the tenant has a year to provide their forwarding address to the landlord in writing, or the LL can keep the deposit. If an address is provided, then the the LL has 15 days to file with the RTB to keep the deposit.

  • You can sue and win a judgement but you're never going to be able to collect once they return to India.

  • I never worried about a tenant leaving early despite a contract. What’s the point? Let them leave. Don’t even bother trying to collect. I even gave back full damage deposit with applicable interest as per law & I always made sure they knew what their rights were.

    If they were good tenants- it was nice having them when they were there and if they were bad tenants - you don’t want to make them upset (for obvious reasons). Every single one of my tenants were nice though, and left the place as good a condition as they found it.
