    The Attorney General has the power to reschedule things... but I'm pretty sure that only applies to things that were added to the schedule system. Marijuana was defined as Schedule I by the law that created the DEA, so they can't legally change that by any kind of executive branch action unless I'm extremely confused about how that law works (which is possible). Instead, Congress would need to amend or repeal that section. On the other hand, the current administration has made it pretty clear they don't think Congress has any say over what they can do, so...

    When I google the question, the top answer suggests that the DoJ has the statutory authority to reschedule drugs, which I guess makes sense because the DEA is ultimately a law enforcement arm of the DoJ.

    So I think the base argument here is that Trump can "order" Marijuana rescheduled via his authority over the DoJ as a part of the executive branch.

    I think the bigger question is what the follow on consequences of rescheduling to Schedule III, which is still a pretty restrictive and includes drugs like Vicodin. If the Federal government's involvement in enforcement of marijuana in legal states doesn't change from its current status quo, then its probably a pretty minor thing for consumers but maybe a bigger deal for the business side, perhaps enabling banking access. It probably makes scientific research much more viable.

    More uncertain might be whether it could enable interstate commerce in marijuana. I think this would probably have good effects on pricing for consumers, but probably crush a lot of smaller businesses that remain viable because they don't have to deal with large, interstate businesses.

    If this gets used as a means of enabling more Federal government involvement in marijuana, it could end up being a huge burden. Some states might backtrack and decide that SIII means curtailing adult use recreational sales since SIII drugs require a prescription (this would be some kind of culture war politics, though, I don't think any state getting rec legal tax dollars wants to shut off that flow). It could mean some kind of new Federal tax, mandated Federal regulation/testing/etc which would just raise costs.

    It's "great" to see it not be Schedule I, but I think anything less than full legalization becomes a minefield.

  • The States don't seem to care what it's classified as when it comes to legalizing sale but the benefit of a more reasonable classification would be to allow federally funded scientific studies. But if you think Trump administration is funding science.. futile hope with that

    Reclassification would also let manufacturer's take certain tax breaks they're not currently allowed to take.

  • The federal government has seriously lagged behind for really stupid reasons. Honestly, most schedule I drugs are there for political purposes and not their danger as drugs.

    We shouldn't hand out hallucinogens to school kids but most of them aren't really habit forming. Very few people who have done LSD do it on the regular. Most of these drugs were put on there to demonize hippies.

    The only ones I think that deserve to be there are heroin(and other powerful opioids), synthetic marijuana, and bath salts.

    Most hallucinogens should be studied because they can have potent and lasting emotional and mental effects. Ecstasy has already shown promise at treating PTSD in trials that have been allowed. There are plenty of companies blazing a trail researching psilocybin and LSD derivatives as treatments for anxiety and depression.

    Partly. The other one was what I was talking about. We had the whole "war on drugs" as a part of a social control scheme against counter cultural movements.

    Don't forget the pharmaceutical industry and especially private prisons as well. In Texas, for example, marijuana related arrests have dropped roughly 30% since the hemp farm bill was introduced in 2018. While that doesn't necessarily mean a 30% decrease in the number of people in jail for marijuana related offenses, it's certainly a significant chunk. If a business loses 25% of its income, they're certainly going to take a long, serious look at the reasons and come up with ways to deal with it. And that's exactly what private prisons are, for-profit businesses.

    If marijuana is to remain a restricted substance in any way and to any degree, and if the proposed reasoning for the restriction is said to be in regard to safety, then, logically, alcohol warrants being restricted to at least the same degree of severity... to a greater degree, if we're to be consistent about it.

    In the United States, more people die from alcohol-related causes than from opioids and fentanyl combined.

    Marijuana doesn't even register on *that* list.
