I was offered an unpaid one week trial. Rejected it.

Isn't this illegal in the US anyway?

    parent
    112 points Away-Reception587

I dont think its in the US

    parent root
    41 points FortaDragon

"Labor" not "Labour", so it'll have to be somewhere US affiliated at least

    parent root
    59 points SorryYouAreJustWrong

    Illegal in UK and Europe.

    parent root
    5 points Penguinmanereikel

    Australia?

    parent root
    2 points brunojcm

    never seen that down under

    parent root
    1 points peepopsicle

    Illegal in Australia too

    parent root
    69 points RebelJediMaster

    Doesn't mean companies won't try

    parent root
    11 points Prestigious-Mode-709

nope. at least in UK, real company won’t even try: risk is too high.

    parent root
    4 points Neo-Armadillo

Generally in the US companies will do whatever they want because the cost of enforcement is extremely high for the claimant. Obviously the government doesn’t care either way. This was probably the US.

    parent root
    2 points scwibblez

Labor law violations are quite literally THE EASIEST things to report and get enforced. If you wanna do the "ahhhhhmerica baaaddddd" thing at least fucking do it where it applies jfc.

    parent root
    4 points DisastrousDiet8367

It is really hard. I spent more than $80,000 upfront on an employment attorney

    parent root
    20 points Easy-Sun5599

Legality seems to be more of a soft suggestion in this country these days vs actual law

    parent root
    7 points Johnnadawearsglasses

    Yes.

    parent root
    9 points Ironspex

There being laws in the USA is a long gone tale.

    parent root
    4 points Green-Inkling

it's only illegal if consequences happen. if a company can keep doing this without having the law fall on them they will.

    parent root
    7 points galaxyapp

    Its probably fake

    parent root
    1 points Dd_8630

There are, in fact, countries that aren't the US.

    parent root
  • 227 points EvangelineRain

Wonder if you could have just done that one week trial then sought compensation afterwards. That’s not legal in most places.

    parent
    136 points JohnThurman-Art

Probably, but the “seeking compensation” part might also be work

    parent root
    15 points EvangelineRain

    Yes, true.

    parent root
    25 points Nanoro615

Then they argue you signed the contract blah blah blah "You VOLUNTEERED" bs

    parent root
    11 points SerialElf

The courts will fully ignore that (they have in the past) but yeah, you still need logs of your hours, and the work of filing the complaint with your LnI or equivalent. It's more effort than it's worth.

    parent root
    3 points EvangelineRain

Labor laws generally supersede contracts. Like you can’t contract around minimum wage.

    parent root
    2 points Hapless_Wizard

It is essentially impossible to legally volunteer for a for-profit corporation in the US. A claim that they don't have to pay you because you volunteered would actually just be them admitting fault; take that shit to the bank.

If you want the full nuance, go look up the court case by the Magic: The Gathering volunteer judges against Wizards of the Coast a few years back that gutted pretty much all officially-supported hobby game community organizer programs.

I am assuming this is in the US because "labor" instead of "labour".

    parent root
    1 points Dd_8630

It's not legal in most Western countries, but it's absolutely legal for most of the world.

    parent root
  • 165 points mindless_balls

Good for you but by the name Sherya I'm assuming this is an Indian company. Sadly they'll 100% find someone else desperate enough for the job. I've had friends who paid money to the company to work internships.

    parent
    35 points strawhatvasiqo

Paying to get internship is a thing in Azerbaijan too. There exists a company just for the sake of it. You pay them, and get to be an "intern" for some months.

    parent root
    2 points ElaineBenesFan

    a/k/a Vandelay Industries

    parent root
    1 points mindless_balls

It's fucking brutal here too man. Like the internship was part of our undergraduate course so students are essentially forced by these fuckers to pay or else they might not graduate. Luckily I think it's not widespread.

    parent root
    1 points strawhatvasiqo

The same as our universities, but ours find you an internship if you couldn't find yourself luckily

    parent root
    4 points scottee25

That was my initial thought too. Many of these Indian companies also offer services to get unqualified people low paying Software Engineering jobs by having someone else interview for them. Then, once hired, they pay slave wages while pocketing most of the hourly rate.

    parent root
    1 points mindless_balls

It's a sad situation honestly. There is a reason why people from India go to the UAE for dog wages. It's still better than the shit offers back home.

    parent root
  • 26 points Jtenka

I'd have accepted the job, called in sick and blagged an emergency to string them along as much as I could just to waste their time back.

    parent
  • 24 points Vegetable-Wing-2804

You dodget a bullet, they sound so cheap

    parent
  • 12 points I-Feel-Love79

Hope the other 51 people do the same!

    parent
  • 10 points mastrbrew

During your 1week trial we will need you to clean and detail the storage area it's gotten messy show us how much you care.

    parent
  • 17 points NoLUTsGuy

In the U.S.:" "I'm sorry, but according to the Fair Labor Standards Act, you have to pay people at least a minimum wage in order for them to provide work. It's against the law for me to work for free, and it's against the law for you to ask me to work for free."

OP, if you are can, get every piece of written documentation about this and report them to the DOL. They'll be foaming at the mouth to take a case like this.

they wanted a free sample of you working for a week as if you were a costco cheese cube

    parent
  • 30 points minkjelly

I would have accepted the job WITHOUT the one week ubpaid trial. Negotiate making that paid and gotten the job.

    parent
    24 points NeoMoose

Right? How hard is "I am willing to accept a paid, 1-week probationary period." Worst they can do is say no, then decline.

Admittedly, this offer makes me think the company wouldn't be that great anyways -- but all I have is one anecdotal hiring practice.

    parent root
    28 points Undersmusic

You really want to believe there’s a job after week 1 huh.

    parent root
    0 points NeoMoose

I know that neither of us know for sure.

    parent root
    3 points DrakeSavory

I wouldn't. If they are willing to do this then you need to expect constant abuse and pay issues if you work there.

    parent root
    3 points SnooApples5554

I'd have accepted and screwed them up so badly they'd never risk it again lol

    parent
  • 4 points femininespace

In Switzerland, they almost always have a Probezeit. Often 1 month. Maybe up to 3. That's where you are paid but you can also be let go v easily without going through tedious paperwork if you were a full time contract employee.

    parent
    19 points blankfilm

Probationary periods exist everywhere and are legal. Some are up to 6 months long. What's extraordinary here is that it's unpaid.

    parent root
    3 points CyberAvian

Some are much longer. US Federal a government has a 1 year probationary period and upon being promoted to manager a new 1 year probationary period begins.

    parent root
    1 points theheartsmaster

As someone who has been a manager in the USA, I like this idea. Eventually, I made everyone start working for me through a temp agency. That way we could simply stop the temp work without any tedious paperwork if the person wasn't the right fit.

    curious: where did it happen?

    parent

I've heard of this with some industries, but they eventually need to pay you for the time worked if you "work out".

    parent
  • 1 points TechNerdinEverything

You should've accepted and then ghosted

    parent
  • 1 points DragonfruitFit2449

I would do it if they pay me apprentice pay which is £5 ish per hour and a glowing reference.

They wanna pay in exposure then do it somewhat fairly.

    parent

brooooo report them to ur local state this is ILLEGAL! you HAVE TO BE PAID AT WORK

    parent
  • -27 points string_bass

Good for you for turning it down. I would have left out that last sentence. You never know when you might encounter Shreya or others from this company in future job searches or endeavors, so it’s always best to remain cordial even with the worst s**t show companies.

    parent
    24 points KeyEstablishment414

    disagree

    parent root
    12 points ResponsibleWater2922

    Hard disagree.

    parent root
    3 points SpicyChill77

I’m really over this line of thought. Companies need to treat people with more respect and stop trying to silence everyone when they are the worst. People should be able to speak freely about companies that cause harm. Cordial is acceptance of how they act.

    parent root
    3 points MisterCrabapple

Bahahaha fuck that noise. Name and shame this slave-whipping behavior.

    parent root
    2 points KittieKatFusion

I agree because people will black list you in the same industry. I've noticed that about the auto industry...

    parent root
