Maybe I remember wrong but didn’t Harry attempt to murder Peter by throwing a live bomb at him while his back was turned, then Peter countered by dodging and webbing the bomb back at Harry? From what I recall the fight was over before Harry decided to try and murder his friend while he was trying to leave the premises.
Yes, that is what happened. But Peter started that fight, and also made no attempt to help or check on Harry afterwards. Had he died, that'd still be a murder charge. Especially when you consider it was all over a woman. Peter didn't care if he lived or died and just left. If there were cameras or witnesses, and that is what was seen, he'd absolutely be arrested for that. The trial may get a bit messy with it being considered self defense, but he was the aggressor.
He hunted Sandman down with the intent to kill him, fought him, drowned him, and then the next thing he did was invite Aunt May over just to happily tell her Sandman was killed.
