We shouldn't need a second full SCOTUS case (we shouldn't need a first SCOTUS case in my opinion but that ship has sailed). McDonald already settle this topic, the states are bound to the 2A via the 14A just like the rest of the Bill of Rights, so all 2A rulings are technically binding on the states as well.
Agreed on both points, but seeing how they kicked and screamed in defiance post-Bruen, I'm thinking they will need to be brought to heel on a state-by-state basis.
Maybe it won't need to go all the way to SCOTUS, but I doubt the 1CA/2CA/9CA will just lay down and roll over.
Among other things, lawsuit seeks "A declaration that the pattern and practice by DC Defendants of prohibiting registration of the AR-15 by law-abiding citizens violates the Second Amendment" and "A permanent injunction prohibiting all DC Defendants from arresting and levying fines against otherwise law-abiding citizens for possessing the AR-15 and all other firearms protected by the Second Amendment and being possessed or used for lawful purposes" https://www.justice.gov/crt/media/1421731/dl
Sue? Doesn't the DOJ have the power to bring charges and make arrests? Maybe they can start with CA lawmakers who willfully ignore Bruin and other SC precedents and continue to pass unconstitutional laws.
Not enough Americans care about freedom, they prefer a nanny state, and they'd see that as Orange Man wraponizing the Justice Department against his political opposition.
Remember folks - this is how Heller started and then we got the McDonald ruling 2 years later to get the rest of the states to come to heel.
This could be it.
Here's to hoping.
