    The broad problem, IMO, is that Americans have just become way too accepting of the idea that the government is allowed to murder people. I'm not sure how we roll that back, but it likely involves civilian oversight boards and consent decrees. The fact that LEO involved shootings are handled by Internal Affairs and prosecuted (if applicable) by the DA who is also a part of the law enforcement is just inherently problematic and full of conflicts of interest.

    Demanding state licensure and malpractice insurance would also probably go a long way.

    Yeah, no. Noem absolutely deserves the blame here. It was under her that ICE started rapidly expanding, and in order to meet recruitment quotas, the amount of training required was significantly reduced. This, combined with the Trump administration conducting large ICE raids for the sake of a perverse public spectacle, undoubtedly contributed to this kind of incident becoming inevitable.

    I'm not a lawyer or a political scientist. I'm sure I am getting some stuff wrong. I also want to be clear I'm not trying to defend the Trump administration's actions here. An ICE agent killing an unarmed civilian is wrong. I just want to help explain some of the legal background of what is going on.

    The federal government is senior to state government. Giving the Fed this seniority was a important part of reforming the weak articles of confederation. The part where this articulated is Article VI Clause 2 of the Constitution which reads

    This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

    I won't pretend to understand all the laws that connect the FBI stopping local police from investigating to the Supremacy Clause. A much more positive example of the Federal Executive being supreme to a State Executive is Eisenhower and the Little Rock Nine. Eisenhower nationalizing the National Guard in Executive Order 10730 didn't cite the Supremacy Clause. Instead it cited

    Chapter 15 of Title 10, particularly sections 332, 333 and 334 thereof, and section 301 of Title 3 of the United States Code.

    So there is a clear constitutional basis for the FBI being "supreme" to the local police and not letting them get involved. This doesn't mean what the FBI is doing is right or good. It just means it has precedence. What it doesn't mean is the state police can't bring Jonathon Ross to trial for breaking state laws. It will be much harder to convict without access to crime scene evidence. If the state was able to convict Ross without access to the crime scene evidence, a pardon from Trump would not be sufficient to have Ross walk free. There may be some way for the Supreme Court to decide that Ross should not be convicted but Trump wouldn't be able to just pardon him using presidential powers.
