Hi. Here is the situation. I am sharing an apartment with another person. Recently, this person told me that 2 of her friends are going to be living here and that I should move out if that happens. Note that we haven't had any problems so far inside the household. There is no contract and I have never met the landlord. This person is in regular contact with the landlord.
I do not want to move out. Does this person have the right to evict me without any cause? Do I have any rights here and what should be my next step?
I appreciate the advice.

After contacting Treshold I found out that I have almost no rights at all. So in this situation here is my best take. Since the property isn't registered, I could use the tax evasion as my leverage to discourage the main tenant with this action. Since they decided this behind my back and without involving me into the conversation they decided to treat me inhumanly, therefore, I have no choice but to give them the taste of their own medicine. I am also in risk of being homeless, so you can bet all you have that I will fight this with all that I have. Unfortunately for them, they are about to experience how it feels like when you corner someone, leaving them no choice but to defend themselves.

    I have been in similar situation few months ago. Tell them you are not going to pay another cent nor move out until you speak with landlord of the house. Do not take any sort of pressure from them, dont do anything without speaking with landlord of the house.

    I'd start locking your room anyway, if she wanted to move friends in its a discussion you'd have, and possibly come to an arrangement on, you can't just say someone should leave when someone new arrives. I'd start locking your room either way, the fact that they refused to allow you to contact the landlord is a redflag immediately, I wonder if they sublet to you without notifying the landlord. You're in a tough situation anyway, landlords who aren't registered tend to get fairly belligerent when the authorities start getting involved.

  • Technically, you can find out who owns the house but you'll need to pay €5 for it and then use your detective skills to track them down. Go to land registry, find the house, pay €5 they will send you the details of who owns the house, then try and find them online.

    If you pay rent directly to the landlord, then you are a tenant with full tenancy rights, and the other tenant has no ability to force you out

    If you pay rent to the tenant, you are a lodger/licensee of that tenant, with no tenancy rights at all. This means that you can be made with 'reasonable notice' and without justification. In practice, the tenant can force you out at any time by changing the locks, because you have little to no recourse if no notice is given.

  • Sounds like you’re a licencee of the tenant. You’re possibility on a “rent to room” basis. Talk to the landlord or their agent. If you are a licencee you can request to become a tenant, that can’t be refused. 2 more moving in could also be overcrowding. TLDR talk to the landlord.

    Wouldn't be surprised if the landlord doesn't know that they are subletting... Rent agreements usually don't allow you to sublet like this from my experience, but I've definitely seen cases in the past where a group of mates moves in, signs the lease eventually one moves out and they just replace that person and don't update the lease - so doesn't surprise me this main housemate is not wanting to share the details of the landlord as it might get them in trouble from the landlord... I'd keep pressing this or once you find the landlord info to tell the housemates you have the info and are going to contact them... They may change their tune.

    You could try asking the neighbours if they have the owners contact info, that you live next door and you lost it. Oh wait I see it's an apartment, they may not know the owner then, better chances if it was a house.... Maybe the management company then

    Ok. You’re 100% a licencee. It’s different to a sub let. Sub let is in the entire of the house. Licencee is not the same. You’re sharing. As it stands you have very little rights. But the tenant is probably breaking the law also and not telling the landlord you’re there. Lob in a hand grenade. Contact the RTB.

    I don’t know if this will work but try contacting the management company of the apartment building (they usually have signage somewhere around the property). Tell them you live in apartment X with person Y and do not have the contact details of the landlord. Give them your details to pass on to landlord as I doubt they will give you the landlords details directly.

    Edit to add: this may still end in eviction as the landlord may not be happy if your house emmet has sublet a room with out the landlords knowledge or permission

    Never thought a tenant could do rent a room like that. Does this mean that tenant should be declaring this on their taxes as they are a rent a room 'landlord'.

    If you don't have contract with landlord but your housemate does (for the entire place), then you are a licensee

    I would just start looking. You are living with an ahole and there is little to suggest they will be any way fair or reasonable to you. This along with the fact you’ve no rights mean you’d be better off looking for somewhere else unfortunately

I know everyone is talking about your rights,which you are entitled to but having lived in hostile house shares before,your peace of mind and emotional health are just as important and this person sounds entitled and not someone it would be comfortable to keep living with if this became an impass.

    Exactly! It’s only when you move away from someone like this do you realise how much it affects you. Home should be a safe space and when it’s not it’s unhealthy to stay in

  • Imo , move on , move out and stop. Sounds like this person did you a favour letting you sub let, which it appears you were happy to do because you stayed there. You had you know your time was limited with such an underhanded agreement.

    Youve found out you have no rights, there is your answer. You're still going to have to find somewhere to stay no matter what you do.youre just wasting time and effort on something that doesn't matter.

    In the end you will be out and this person will have their 2 new flat mates. Focus your energy on finding somewhere to stay

  • Yes they do have the right. It’s temporary stay and you’ve been told - there are new tenants on the way. They’re telling you to find something else. You don’t have rights here
