Trying to understand an unfolding legal situation: a family member is affected but I don't have the full details (so trying to figure out from what we've been told).

What we've been told is that they have been court-order barred from returning home, but they live alone. The house isn't social housing, but isn't directly owned by them. They are on social disability due to long term mental health issues (which unfortunately are at the root of all this). Reading online, a barring order is only for people living together. Can you be barred or restrained legally from their home for other reasons (such as from neighbours)?

Also, as this person is under a disability, they would become effectively homeless. Is the state required to provide some form of accommodation in this case?

Thanks

  • Who told you this? Who is supposed to have applied for barring order? Is there any paperwork that you have seen?

No we haven't seen any paper work yet.

What we've been told by the Gardes, the Judge issued the order based on the neighbours evidence. This all happened suddenly yesterday, which were scrambling to understand what's going on. They do have a solicitor, but the solicitor won't talk to us.

So it sounds as though the relative may have been so threatening toward the neighbors as to have been told not to come within 100 meters of them. And no papers served on your family member or given to them. The Court Registrar would be able to help but will not deal with third parties.

And you don't know of your family member was at the hearing and if they were they were not legally represented.

It all sounds very unusual and Kafkaesque. Can the Garda give you any concrete info? Again they won't deal with third parties
