I purchased a car from a dealer roughly 9 months ago and it had a fault when I bought it. The dealer repaired it within 2 weeks and I was told the issue was resolved.

The car seemed fine until today when the fault came back up again. I rang the dealer and was told tough, it’s nothing to do with them as warranty was only 3 months.

My question is, what are my rights as a consumer if the car was sold with the fault and it is 6 months out of warranty but the fault still persists?

  • Without knowing what the fault is, or the age of the car, it’s harder to give an opinion.

    But, In 99% of cases this is indeed your problem.

    You’re out of warranty. They fixed the fault after you bought the car and it’s been fine until now. A lot can go wrong with a car in 9 months.

  • Do you have a paper trail of you first contacting them during the warranty period? Is it the exact same issue that has returned?

    This exact same thing happened to me and the onus is on them to sort it. They sold you a car with an issue, and the issue was not fully resolved if it has returned again. I was told to send a strongly worded email looking for it to be sorted within 14 days, and if not I was told get the car repaired and go through small claims for the costs.

    Thankfully the email scared them, as under Consumer law it’s seen that I was sold a car which had an existing issue which was not fixed during warranty period and then returned again.

    Yeah I have text messages of them admitting the fault when it originally occurred when I bought the car.

    They said because it’s been a few months since the original repair that it’s out of warranty and up to me to fix it but it is the same fault that the car had when I purchased it.

    I had to get it towed to a garage as I was stuck on the side of the road and after a phone call the dealer said they already rectified the issue months ago with the original repair so tough luck basically. I will likely have to go the small claims route to recoup repair costs now.

    Is what the fault is a secret?

  • Unless you tell us the fault, we are unable to see if the fault is a consumable part that just goes, or if it's a more serious part that has failed.

  • How old was the car and how much did you pay for it?

  • A lot depends on what particular fault it is but if it operated fine for 8 months without it showing up then they can't really be held liable
