Troubles started in August when my husband and I complained about excessive noise from neighbor to HOA and the county noise complaint hotline. The complaint was dismissed by both. My husband and I said, “oh well” and gave up. Last week after things were settled the neighbor filed a restraining order that was denied but included a false complaint and false evidence that my husband is violent towards me in the restraining order (it goes into detail with a false timeline). Also, mentioned in the order that his family is concerned for their safety. We are a very passive couple, who do not believe in owning firearms or physical violence against another. The neighbor owns firearms and has decals on his truck of ak-47s. He is also a meathead and a huge buff dude who is constantly yelling and usually under the influence of marajauna.
In the past couple years of living next to these people we have let a lot of things slide. Their dog has damaged our fence by pushing though the chicken wire and entered our yard multiple times, and they have driven their vehicle in our front yard creating ruts.
Our neighbor across from these people have seen the husband holding a firearm in his truck.
My question is, since NC is a stand your ground state, are we in danger and does it sound like he is building a case to use deadly force against my husband? What actions or inactions would be recommended, do we need legal representation? We genuinely fear our safety as a result of the neighbors' false claims.
We want to move but are unable to afford a new interest rate, so that isn't an option. We have a young child as well if that helps to know.
Location: Meck county, NC. They are directly next to us and are renting, we own our home.
Call the neighbor who owns the house they are renting and tell them about the dangers of their renters, and send them videos
We have reached out to the owners about the fence (at the time of the incident) and the noise but never got a response.
I guess call the local sheriffs office with videos as proof then
