Slightly related, but the other day someone was arguing about how, legally speaking, for murder you need to prove intent and just the perpetrator knowing the other person would likely die as a consequence of perp's actions was not enough. Then the commenter compared it to killing someone while drunk driving and how silly it would be if we prosecuted that drunk driver for murder just because he chose to drink and drive and knew he was a lethal danger to other people on the road...
