They were allowed to put the Santa back up but, we still don't know what the actual rule that was broken. the management company had sent the owners a notice to take it down or be fined but neither the management company nor the owners ever stated what actual CC&R rule they violated.
So as far as I'm concerned, the owners never violated a rule because there probably was no rule for the violation. Nobody did their homework to verify the rule, the HOA community banded together to get Santa back, the management company knew they fucked up because they looked again and found no rule, sent the owners a letter indicating the mistake but still didn't actually say there is no rule for a height restriction.
Next the need a giant leprechaun for St. Patrick's Day a giant Easter Bunny for Easter, and a giant Uncle Sam for from Memorial day through at least the Fourth of July.
The letter did not state specific height restrictions but was accompanied by a list of possible fines. yeah........that's a dumb HOA person. Cite the rule or STFU.
