    They can’t because of double jeopardy unfortunately. I heard the judge retiring is fake news. We need to keep the pressure on. Everyone who was involved in this decision needs to be heavily scrutinized and ideally disbarred. Hell they should be jailed but I’d settle for disbarred and disgraced.

    Fun Fact about the Fifth Amendment! It says (relevant part only) “nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb”. So technically, you can be tried for the same offence more than once. You just can’t receive the death penalty as the sentence for it. Or, loss of extremities. But I don’t think imprisonment would qualify as putting limb in jeopardy, so yeah. 👍

    The only punishment that should be applicable to a rapist is a lead pill to the cranium. Castration doesn't prevent it from committing most of the crimes that the one we're talking about here has been charged with. The only way to ensure a rapist never rapes again is getting rid of the pest. While i understand the need to punish it and inflict pain upon it, it brings no consolation nor positive input into the case.

    No, rapists should get life sentences and mixed into high sec population or death row for the entirety.

    Death is far too merciful, and there's a reason why society allows rapists to continuously get a taste of their own medicine in those settings.

    The thing about death is, most of it is quick. Even with injections it's a few mins of hell and it's over. A life sentence in that environment is a life sentence to hell.

    If you rape someone - especially a child - you took whatever life that they had from them. The life they get after will never be the same. They will be traumatized, and the lucky ones will get to heal, while most won't. Most will fall into worse patterns, nearly every person in America sitting in a drug rehabilitation facility or 12 step program was the victim of some form of SA as a youth.

    Rapists take lives, they should have their lives taken from them too. Do you believe in hell? Bc I don't, and I'd like to make sure those people do. I'm not ruling the dice on divine justice, I'm* putting them on the scales.

    This image isn’t even exposing the worst shit. He choked the girls on video, one so hard she was in the hospital for a long ass time getting her throat reconstructed and was dead for 30 seconds. He will absolutely rape and murder again. Especially to avoid getting caught.

    I can't find a source for the mom knowing, but I kept hearing about it when this story first broke. Maybe that's not true. But one victim did need surgery.

    Oh I read about how he choked her so bad she was actually “lucky to be alive” and I saw the video where the mom told him to “just relax and pray” like all he did was steal a bike or something she had zero concern or worry… the ONLY silver lining is that he’ll forever be on the offender’s list

    Minors can absolutely be on the offender’s list and he was 17- hardly considered a “minor” and when it comes to extremely violent crimes such as aggravated raped and aggravated assault, attempted murder etc. (Which he did all three) the actual “age to be charged as a minor” is usually 13 and below, 14 and above can be more easily charged as adults. I could be wrong but I believe he was originally being charged as an adult, but then the court “status changed to minor” probably due to a plea deal….

    He also pleaded no contest which means he’s not “not guilty” and took instead a plea deal where he pleads no contest to avoid court, and is still convicted of the (more commonly) lesser charges than the ones he was charged with.

    He pleaded no contest to: “sexual assault, strangulation and domestic abuse in connection to the rape of two female teenagers” and avoided prison- which is NOT the same as being found “not guilty”. Therefore I definitely believe he will absolutely need to be on the registry although I would need to search that up to be sure.

    What I heard is that they changed the charges from adult to youthful offender. That makes it sound like he stole a candy bar from the 7-11. He better be on a list.

    Is "no contest" like an Alford plea, where you don't admit guilt, but admit they have enough evidence to convict you? I think that's what it is.

    It means you’re not going to admit wrong doing but also not going to fight the charges against you (usually because there’s enough evidence to charge you but “might be a lengthy trial” so prosecutors offer a plea deal where they lessen the charges and you agree to “accept them without admitting guilt”).

  • Let this case and many many MANY like it come to your mind whenever a case against female perpetrators comes up. Because way too many times I see comments like “If the roles were reversed, it would be taken seriously.” No it wouldn’t. It certainly wouldn’t.

    We have a culture of rape apology. Victims get more blame than rapists. And they are held more accountable for the aftermath than their rapists are. You can rape multiple people and face less time than if you were caught with drugs on you. Think about that. It’s…ow. 🙁

    He was in imminent unavoidable threat of death and serious bodily harm.

    Now you can have you convictions about whether it was good idea to be there in the first place but that is what the evidence shows and what the jury decided.

    I think deliberately putting yourself in a situation where you are at risk of unavoidable threat of death and/or serious bodily harm should negate that as a defence, personally, especially if there's documented evidence of you talking about how much you want to shoot protesters beforehand.

    Not to mention that the second guy he killed, and the guy he maimed, were reacting to a guy - from the opposite side to that of the protesters - who'd just shot an unarmed man dead on the street by trying to subdue him; even if we want to argue that the first guy he shot was justified I don't think the second two were.

    It's plausible that he panicked in the moment, because he was a stupid fucking kid who'd gotten himself in way over his head, but the eagerness to kill protesters he'd openly displayed previously makes it very hard to argue that there wasn't an element of, if not premeditation, then awareness that killing someone might be a distinct and possible outcome of his actions that night.

    It would be like me walking out into the middle of a busy intersection, having expressed a hatred and desire to kill people who drive cars, then opening fire on and killing the driver of the first car coming directly at me because there was an imminent and unavoidable threat of death or serious harm. I chose to walk out into the middle of the street; the fault should be mine.

    I would say one example would be when that 10-year-old girl was all over the news because she was raped by an adult and got pregnant and because of new bans in her state she had to travel to get the care she needed. A raped 10 year old where the laws voted in by conservatives would have meant that she would have been forced to give birth. Not every 10-year-old would come from a family that can afford to travel
