It doesn't actually matter; Congress must affirmatively vote to enable the use of force. This is really just a political display, it's not necessary to make Trump's actions unlawful.

The Democrats really only have one move in Congress, and that is to refuse to appropriate any funds for anything and let the government shut down completely. It's an extreme remedy, but that's where we are.
States have some other options, like criminal charges against ICE, but that's more complex.
