Hello everyone. I have an issue with E.ON and STAWAG (I live in Aachen) and would like to ask for your advice. I’m so sorry that my german skill is not good to explain everything so I will explain it in English.

I registered for an electricity contract with E.ON two months ago (12-month term) because that was when I had just moved into this apartment. Last month, they sent me a letter saying that they could not find my data at the municipal electricity provider (STAWAG) in order to carry out the switch.

After that, I found out that the electricity contract for this apartment with STAWAG is still under the name of the previous tenant, so E.ON was unable to find my information at STAWAG to proceed with the switch.

Immediately afterwards, I sent E.ON an email including the apartment handover document from the previous tenant to me, along with photos of the electricity meter showing the reading on the day I moved in.

However, at this point everything feels very complicated, and I would like to resolve the issue of the electricity contract being under the wrong name with STAWAG first. Therefore, I sent an email to E.ON requesting the cancellation of my application.

I received a contract number (Vertragsnummer) from E.ON two months ago, but the status has always been “Ihr Vertrag wird bald in Belieferung sein” (“Your contract will soon be in supply”). I have never received any written confirmation that the contract has actually become effective.

I understand that contract with E.ON can usually be cancelled within 14 days after signing, but in my case the contract has not even yet taken effect, right?

I would like to ask whether anyone has experienced a similar situation, whether sending an email to request cancellation is sufficient, and how long the processing time usually is. Could I be charged a penalty or asked to pay electricity costs later on?

They always reply to emails very slowly, so I am planning to go to their office in Essen in person on Friday, 02/01, to request the cancellation directly.

  • By attempting to cancel your contract with EON you are making things even more complicated. STAWAG is the default electricity provider in your region. If you do not have a particular contract with them or a different provider, your electricity is provided by STAWAG at list pricing which is usually rather expensive. 

    When the previous tenant left the apartment, STAWAG should have been informed that their contract ended and that you as the new tenant have chosen EON as a provider starting with the start date specified in your contract with EON. Once your contract with them has been signed, it’s active, and the cancellation terms laid out in the contract apply. It sounds like that’s 12 months from the contract start date in your case. You also have to pay your contractually agreed fees to EON once the contract start date arrives. 

    Now, the duty of implementing the actual provider switch for your apartment is on EON and STAWAG. Issues can arise, but given that you shared your meter number and Übergabeprotokoll with EON, everything should be sorted out quite quickly now. You are still only bound to EON and need to pay for their services from the start date of the contract, meaning the last few months and until the end of the contract. Any issues in billing in the last two months should be sorted out between STAWAG and EON. 

    I’m already paying for Stawag. I dont think my contract with EON is already active now cause it’s always “wird bald in Belieferung sein”, i tried to chat with a customer service guy from EON once and he told me that they are still working on it. And on the website i checked my vertrag and it says

    “Ihr Netzbetreiber lehnte die Anmeldung ab. Wir klären das aktuell für Sie. Sie brauchen nichts weiter tun und bei Bedarf kommen wir auf Sie zu.”

    So i think the vertrag is not active yet? They have not given me any service yet so that it’s possible for me to cancel the Anmeldung? I also plan to go to Essen to talk to them next week and hope they can cancel my Anmeldung

    Why and how are you paying for STAWAG when you have a contract with EON? Did you close a contract with them as well! Your contractual obligation lies with EON. It’s their job to figure out the stuff with STAWAG. Which they even told you in the message they sent you. Legally, there can only be one provider per meter. If there is an overlap like in your case, the providers have the duty to figure it out. If you signed a contract with EON to receive electricity via them from day 1 of moving into your apartment, that is the contract that counts - unless you signed another contract with STAWAG BEFORE you signed with EON. Go to their office, but be aware that just because the Belieferungsstatus is still pending it doesn’t mean that EON isn’t fulfilling their obligations at the moment. STAWAG’s job as Grundversorger is to make sure no apartments go without electricity. If there is an issue with handing over your meter from one provider to the other, it just means that EON continues to collect your payments and, if necessary, reimburses STAWAG for the time that they had to cover your apartment’s electricity until the  moment EON took over. 

    So, the key question is when you signed with which provider. 

  • I had a similar problem in Berlin.

    I went to Vattenfall. They had no problem switching the contract/electricity meter.

    With E.ON, I simply went to the cancellation page and terminated the contract without notice due to the long waiting time. The contract was then canceled by E.ON.

  • A tip from me: the problem is EON; the supplier isn't known for its reliability, and I've only had problems with them myself.

    Do you still use their service or did you also cancel a contract with them?

    I had one problem after another, so I just canceled the contract. You'll find lots of people online who have exactly the same problems.

    Did they charge you for anything when you tried to cancel the contract?
