We bought a home and close January 2nd. We told our landlord we would be out of the unit the first week of January. However we are out of state right now living with family until the closing date. They are scheduling tours and we are obviously not living there currently as there is moving boxes and we cleaned out my sons room so they will notice that it’s mostly just stuff we have to come back for like furniture. Is it legal to leave it vacant for 3 weeks without telling them? Nothing in the lease that says as such.
Why wouldn’t you just message them?
It was 5° here in Charleston last night. They need to make sure the place is winterized appropriately if you aren’t going to be there.
It’s a townhome with 10 units so the maintenance guys are there daily doing work outside the property including snow removal. I believe my fiancé told them we wouldn’t be there much in December but I’m not sure if they know we aren’t living there currently.
It's cold in NJ. What did you leave the heat at?
Did you shut off the main water supply so the pipes wouldn't freeze?
If not, notify the LL in case they need to address this. You've been gone a long time for water to not have been run at all in cold weather.
Letting them know is a courtesy and a good thing if it is really cold and the HVAC should go out to avoid a pipe bursting. If you are paying rent don't need to occupy one day as long as rent is paid
Is there a reason for not telling the landlord?
Otherwise, in most leases there is a statement that says if the place is going to be vacant for x days the landlord needs to know or the lease is canceled, you should double check your lease about that.
We let them know we would be out of town this week but I guess just thing not to complicate anything until we have to be out on January 10th.
Check your lease if you are worried, tell them you are out of town if you are not.
Tenants are allowed to go on vacations for three weeks (or more).
What does your tenants policy state? Our insurance ataes we have to documented that someone checked on it every 3 days when temperature is below freezing or weekly otherwise.
We have cameras now so that time stamp works. Before, our house sitting would just snap a photo and what's app it (meta data showed when taken plus time stamp when sent).
You don’t have to tell them unless stated in the lease. However, if something goes wrong, and no one to check, you may be on the hook
Just give the manager a heads up you are ‘traveling’ and will be back on ….
I travel a lot and when I rented, I always have them a heads up if I was going to be gone more than 3 days.

If you paid your rent, do whatever you want. Just set thermostat and lock the doors.
If your lease doesn’t stipulate then there’s no issue. Any notice is a courtesy.
