The way I read it, it's not a good faith argument. It's a criteria intentionally chosen to give them maximum leeway for capricious and arbitrary decisions.
Passports are also prohibitively expensive for many people, especially if you're only needing one for ID purposes. Not everyone has a couple hundred bucks to spend on a passport just in case they get stopped by ICE.
I live alone and have a slow metabolism, so I only really eat like one meal a day most of the time, so that helps a lot. I buy a lot of things in bulk, and only go grocery shopping once a month so it's easy to track expenses. One trip per month, no math. I've got a 20lb bag of rice I've been making my way through for several months. I focus on produce that doesn't go bad quickly, like onions and apples. I know people with apple trees so sometimes I get some apples for free. I pretty much only buy meat if it's on sale, or rarely I'll get a rotisserie chicken from Costco for $4.99 and I can stretch one of those for 3-5 days, + the stock I make with the bones. I have a giant thing of popcorn, it's ridiculous, I've literally had it for like 3 years now and it's still half full. I like to stockpile non-perishables when they go on sale. A pot of rice with some canned tomatoes, beans, and cheese is easy and filling and costs very little.
I'm better off than a lot of people because I have an apartment, clothes, a car with insurance, and my fridge has food in it. I am currently meeting my survival needs and I don't have debt. An extra $165 this month could very well put me into debt though, because my budget is tight. I can pay for what I need and nothing else.
For folks who just had their insurance costs quadrupled and have already been struggling with rising grocery bills, any incidental over $30 is going to be somewhat of a hardship.
And for those living paycheck to paycheck? Some people can't afford to keep their lights on, it is prohibitive for certain people. You are just not of that group so don't see it as such.

If you need your birth certificate contact the city clerk in the city you were born in (where the hospital is). Once you have that you can get a Social Security card directly from any Social Security office. Once you have both of those documents you can apply for a passport.
The hospital where my records were stored burned down decades ago, I've been told there is no possibility of getting a replacement despite having a valid social security card.
I'm formally a Floridian. The hospital I was born in is an overpass now. Check the vital statistics department. I got a birth certificate from them with a barcode on it. I had to have it to get the Real ID drivers license they forced on us. Now that doesn't count.
Google "Vital Statistics Department" in your own town, it will lead you there in person but you absolutely have to make an appointment, its not walk in anymore.
I don't know the particulars for your state, but at least in mine (IL), they also have a record of this so you could possibly request a certified copy from your state government? Worth looking into! It's what I had to do.
My birth hospital is torn down now, but I was able to get a state certified replacement for my birth certificate since it was old and literally crumbling to the touch. It's not a quick or smooth process, but it's possible!

Occasionally on a really serious felony case, I've heard a judge order a condition of release of not leaving the state of MN, but it's not common & they don't order anyone to turn over their passport.

So ICE is just gonna stand outside Disneyland looking for any nonwhite family about to go inside so they can detain them because they don’t have American passports and left their visa at the hotel? I've been carrying my passport card since November 2024. Suppose that 180 million US citizens don't have passports. If they got a passport only, that is $29.7 billion in revenue, plus annual revenue of about $6 billion for renewals.

I'm formally a Floridian. The hospital I was born in is an overpass now. Check the vital statistics department. I got a birth certificate from them with a barcode on it. I had to have it to get the Real ID drivers license they forced on us. Now that doesn't count.

Google "Vital Statistics Department" in your own town, it will lead you there in person but you absolutely have to make an appointment, its not walk in anymore.
I wouldn't even try to drive there, it's several states away.

I don't know the particulars for your state, but at least in mine (IL), they also have a record of this so you could possibly request a certified copy from your state government? Worth looking into! It's what I had to do.

My birth hospital is torn down now, but I was able to get a state certified replacement for my birth certificate since it was old and literally crumbling to the touch. It's not a quick or smooth process, but it's possible!

Your state has an office of vital records. Find it and contact them to get a copy. There will probably be a fee. Get a couple of certified copies.

Waiting for the other shoe to drop - specifically changes to the passport application process so that only the "right" kind of US citizens get passports. Like maybe a review of all your social media history to confirm you have never said anything bad about Trump or the alt-right and never supported any left wing causes or people, etc.
This shoe dropped months ago and made it very very difficult for trans folks to get or renew their passports, especially if they'd previously changed their name or gender.

That's not accurate, at least not in Minnesota. I've been a public defender for almost 17 years Occasionally on a really serious felony case, I've heard a judge order a condition of release of not leaving the state of MN, but it's not common & they don't order anyone to turn over their passport.
I know another country that uses “administrative detention” to ethnically cleanse the land.

So ICE is just gonna stand outside Disneyland looking for any nonwhite family about to go inside so they can detain them because they don’t have American passports and left their visa at the hotel? The more amusing part is believing that ICE agents will accept government-issued documents as acceptable proof of citizenship in all cases.
